1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of Maskchat (“we”, “us”, “our”) and all related products and services, including our:

  • AI-powered messaging tools

  • WhatsApp Store Front

  • Integrations (e.g., Shopify, WhatsApp, other platforms)

  • Website and dashboard

By creating an account, using our services, or accessing our website, you agree to be bound by these Terms. If you do not agree, you may not use our services.

If you are using Maskchat on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Services Provided

Maskchat provides tools that allow businesses to:

  • Automate and manage customer conversations via channels such as WhatsApp

  • Enable WhatsApp Store Front for product display and order capture

  • Integrate with platforms like Shopify to sync products, orders, and customer data

  • Automate reminders, notifications, and marketing messages

  • Use AI to support customer interactions and streamline communication

We may update, improve, or modify features at any time to enhance performance, security, or usability.

3. Account Registration & Responsibilities

To use Maskchat, you may be required to create an account and provide accurate and complete information.

You are responsible for:

  • Keeping your login credentials secure

  • All activities that occur under your account

  • Ensuring your use of Maskchat complies with applicable laws and regulations (including messaging, privacy, and data protection laws)

You agree to notify us immediately if you suspect any unauthorized access or breach of your account.

4. Acceptable Use

You agree not to use Maskchat to:

  • Send spam, unsolicited bulk messages, or abusive content

  • Send illegal, harmful, or deceptive content

  • Harass, threaten, or defame any individual or entity

  • Violate any applicable law, regulation, or third-party right (including WhatsApp/Meta policies, telecom rules, privacy laws)

  • Distribute malware, viruses, or other harmful code

  • Attempt to reverse-engineer, decompile, or interfere with the platform’s operation

  • Misrepresent your identity or affiliation

You are solely responsible for the content and messages you send through Maskchat, including:

  • WhatsApp campaigns

  • Automated reminders

  • Order confirmations

  • Any marketing or promotional messages

You must ensure that your recipients have provided appropriate consent to receive messages where required by law.

5. Third-Party Services and Integrations

Maskchat may integrate with third-party platforms (such as WhatsApp, Shopify, payment gateways, analytics, and other tools).

Your use of these third-party services is subject to their own terms and policies. We are not responsible for:

  • Availability or performance of third-party platforms

  • Changes in pricing or policies of those services

  • Any content or data handled by them outside our control

6. Plans, Fees & Payments

Some features of Maskchat may be offered on a paid subscription or usage-based model.

  • You agree to pay all applicable fees for the selected plan or services.

  • Fees, billing cycles, and payment terms will be described on our website or in your order form.

  • All fees are typically non-refundable unless otherwise stated in writing or required by law.

We reserve the right to:

  • Change pricing or plans with reasonable notice

  • Suspend or terminate access if payments are overdue or unsuccessful

7. Trial Periods & Promotions

We may offer free trials, promotional pricing, or discounts.

  • The duration and conditions of each trial or promotion will be specified at the time of offer.

  • We reserve the right to modify, limit, or cancel any trial or promotion at our discretion.

8. Intellectual Property

Maskchat and all related content, features, branding, and technology (excluding user content and third-party content) are owned by us or our licensors.

You are granted a limited, non-exclusive, non-transferable license to use our services for your business purposes in accordance with these Terms.

You may not:

  • Copy, modify, distribute, or create derivative works of Maskchat

  • Use our brand or trademarks without prior written permission

  • Remove or alter any copyright or proprietary notices

9. Your Content

You retain ownership of the content and data you submit to or generate through Maskchat, including:

  • Messages

  • Conversations

  • Product details

  • Customer information

By using Maskchat, you grant us a limited, worldwide, non-exclusive license to:

  • Process, store, and use your content solely to provide and improve our services

  • Analyze anonymized and aggregated data to enhance product performance (without identifying you or your customers personally)

You are responsible for ensuring that:

  • You have the necessary rights to share this content with us

  • The content does not infringe any third-party rights or laws

10. Service Availability & Modifications

We aim to keep Maskchat available and running smoothly, but we do not guarantee:

  • Uninterrupted or error-free service

  • That the platform will always meet your requirements

We may:

  • Modify or discontinue features

  • Perform maintenance or updates (which may temporarily affect availability)

We will use reasonable efforts to schedule major maintenance at times that minimize impact.

11. Disclaimer of Warranties

Maskchat is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Fitness for a particular purpose

  • Merchantability

  • Non-infringement

  • Accuracy or reliability of any results or outputs

You use our services at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or related to your use of Maskchat.

  • Our total aggregate liability for any claims related to the services shall not exceed the amount you paid to us for the services in the three (3) months preceding the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Maskchat and its officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the services

  • Your violation of these Terms

  • Your content or communications sent through Maskchat

  • Your violation of any law or third-party right

14. Termination

You may stop using Maskchat at any time.

We may suspend or terminate your account if:

  • You breach these Terms

  • You fail to pay fees when due

  • We are required to do so by law or a third-party provider

  • You misuse or abuse the platform or other users

Upon termination:

  • Your right to use the services will end

  • We may retain or delete your data in accordance with our Privacy Policy and legal obligations

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date and may notify you by email or through the service.

Your continued use of Maskchat after any changes constitutes acceptance of the updated Terms.

16. Governing Law & Dispute Resolution
